Media release 20 March 2024 – WorkSafe extends transition period for mines statutory positions.
WorkSafe is extending the transition period to complete the mining statutory position certification from 30 March 2025 to 30 March 2026.
Under the Work Health and Safety (Mines) Regulations, statutory positions carry out specific functions at mining operations. They are classified into several categories, with different functions and obligations, levels of knowledge, experience, and formal qualifications. Some positions require statutory certificates.
After this 2026 deadline, the person appointed must meet the eligibility criteria for their statutory position, including having passed any required examination. The extended transition period will ensure applicants can attend the relevant examination.
Under the Work Health and Safety (Mines) Regulations 2022, the following units are required for individuals who are appointed in statutory positions.
WHS Risk Management Units for Statutory Positions Level 4 (Supervisors) – 2 units
Course Overview
This program meets the requirements of the Work Health and Safety (Mines) Regulations 2022 for units for statutory positions.
The following statutory positions (pitched at an AQF Level 4) require two units of competency:
- Underground supervisor (non-coal)
- Underground supervisor (coal)
- Restricted quarry manager
- Statutory supervisor
- Mine air quality officer
- Noise officer
- Electrical supervisor
Units Required:
1. BSBWHS411 Implement and monitor WHS policies, procedures and programs
2. RIIRIS402E Carry out the risk management process
Learning Outcomes
At the completion of the workshop for WHS Risk Management for Statutory Positions Level 4 (Supervisors) participants will be able to:
- Plan and prepare for implementation of the WHS risk management process
- Identify workplace hazards
- Assess workplace risk and identify unacceptable risk levels
- Identify potential actions and develop risk controls
- Implement and evaluate the risk controls
- Audit the risk management process and complete records
- Communicate, consult, and provide information and training to the work team about WHS policies and procedures

3. Recognition of Prior Learning (RPL) – Available for participants with extensive experience related to these units. Participants must complete relevant assessment documentation and provide evidence that meets the relevant units.

WHS Risk Management Units for Statutory Positions Level 5 (Managers) – 3 units
Course Overview
This program meets the requirements of the Work Health and Safety (Mines) Regulations 2022 for units for statutory positions. It covers the application of risk management and work health and safety for holders of Statutory Positions, in accordance with Schedule 26 of the Work Health and Safety (Mines) Regulations 2022.
These Regulations detail the requirements for the appointment of persons to statutory positions, which have specific workplace health and safety responsibilities. The following statutory positions (pitched at an AQF Level 5) require three units of competency:
- Site senior executive
- Exploration manager
- Underground manager (non-coal)
- Underground manager (coal) Quarry manager
- Underground ventilation officer
- Radiation safety officer

1. BSBWHS411 Implement and monitor WHS policies, procedures and programs
2. RIIRIS402E Carry out the risk management process
3. RIIRIS501E – Implement and maintain management systems to control risk
